Service Plan - Terms and conditions
These terms and conditions, together with the Service Plan Agreement, set out the terms of the contract between Caffyns PLC and you. Please read this documentation carefully.
1. Definitions
"We” and "Us" mean Caffyns PLC, "You” means you, the customer named in the Service Plan Agreement. The words "Our” and "Your" shall be interpreted accordingly. Other expressions used in these terms and conditions which are not specifically defined shall have the meanings set out in the Service Plan Agreement.
2. Purpose of the Service Plan
We undertake to make available to You, for Your Vehicle, the services set out in the manufacturer’s service schedule (available on request from Your supplying dealership) at the price stated in the Service Plan Agreement. Services will cover the manufacturer’s maintenance schedule for Your Vehicle, enabling the service book to be stamped. You will need to pay separately for other additional elements such as extended service maintenance items (available on request from Your supplying dealership) including but not limited to, cam belt replacement, changing of brake fluid, changing of engine coolant etc, and wear and tear items, including but not limited to, replacement brakes, tyres, wiper blades, exhausts, bulbs, for example.You undertake to make the payments set out in the Service Plan Agreement, and We will give credit for those payments against the price for the services.
3. Arrangement of servicing
We recommend that:Your Expected Annual Mileage (as per the Service Plan Agreement) should be an accurate reflection of Your expected annual mileage, as a higher mileage than that noted in the Service Plan Agreement may result in the servicing being required sooner than anticipated, in which case You may have made insufficient payments to obtain the relevant service under the Service Plan Agreement and You would have to pay an additional amount to obtain the service (see paragraph 4 below).You should submit Your Vehicle for service In accordance with the Manufacturer Recommended Tolerance Levels, (see Your service book for specific details) in order to maintain the validity of Your manufacturer's warranty.You should ensure that You make appropriate advance arrangements for an appointment and keep accurate records of servicing in Your Vehicle's service history log book.
4. Charges
If You are paying by Direct Debit instalment Your bank account will be debited with the amounts, and on the dates stated in the Service Plan Agreement.If, at the time of servicing, the amounts debited from Your bank account (less any amounts already debited to previous services under the Service Plan) are less than the price for the relevant service, then You will have the option of paying the difference to Us before the service Is carried out or cancelling your Service Plan. Please note that this situation may occur if (for example) Your actual mileage exceeds Your Expected Annual Mileage and therefore the relevant service appointment occurs sooner than predicted.
5. Cancellation
You may cancel the Service Plan Agreement by giving Us 30 calendar days written notice to the Caffyns PLC Dealership that issued the Service Plan Agreement, at any time before the Service Plan Agreement End Date. We may cancel the Service Plan Agreement in the event of non-payment by You of any direct debit, or in the event that You have still not received any of the services within 6 months after the Service Plan Agreement End Date.We may also cancel the Service Plan Agreement In the event that You no longer own the Vehicle specified in the Service Plan Agreement.Following cancellation, Our obligations cease forthwith. We will refund to You an amount equal to the amounts paid by You less the price for any service(s) which have been provided to You under the Service Plan Agreement, less an administration fee of £25.00.In instances where the Service Plan Agreement has been sold to You by telephone or e-mail then no administration fees will apply if You give Us written notice of cancellation within 7 working days of the Service Plan Agreement start date.
6. Transfer of the Service Plan and sale of Your Vehicle
The Service Plan Agreement is entered into between Us and You, for Your sole benefit. You may not give or transfer any rights, benefits or obligations to any third party.The Service Plan Agreement cannot be transferred to any other vehicle. Accordingly, If You cease to own Your Vehicle, You may wish to cancel the Service Plan Agreement and have your payments refunded to you or transfer your funds to a new Service Plan Agreement for any new vehicle you buy. Any refund would be subject to the deductions mentioned in paragraph 5 above (the administration fee will be waived if you buy a new Service Plan Agreement).
7. Other promotions
The Service Plan Agreement cannot be used in conjunction with any other service promotion.
8. Data Protection
The personal information provided by You will be held and used by Us in administering the Service Plan Agreement and providing the services and products required in connection with it. We will not share Your information for marketing purposes with companies outside Caffyns PLC. We will disclose information if and to the extent required by law. If you do not wish to receive information from Us about products and services We think may be of interest to You, please tick the box overleaf
9. Limitation of Liability
We shall not be liable to You for any failure by Us to comply with these terms and conditions by reason of matters beyond Our reasonable control. Caffyns PLC usual terms and conditions apply to all work carried out under the Service Plan Agreement. These terms and conditions are on the reverse of our invoices and copies are available on request from the branch that issued the Service Plan Agreement.
10. General
This agreement is subject to the laws of England and Wales, and any dispute arising out of or in connection with it shall be subject to the exclusive jurisdiction of the courts of England and Wales.If any part of this agreement is held by any competent authority to be invalid or unenforceable in whole or in part then the validity of the remaining parts shall be unaffected.
11. Correspondence
All written correspondence should be sent to Us to the Caffyns PLC dealership stated in the Service Plan Agreement.
